The important bits in plain language. HyperOS is a free, community, non-commercial project — here's how it works and what you agree to by using it.

Plain-English summary: HyperOS is free and community-made. It's not sold and isn't a product. You use it at your own risk, you need your own valid Windows license, we use no cookies (only privacy-friendly, cookieless analytics) and collect no personal data, and we're not affiliated with Microsoft. 1. Acceptance & eligibility

By downloading, installing or using HyperOS, or by using this website, you confirm that you have read, understood and agree to these terms. If you do not agree with any part of them, please do not download or use HyperOS.

You should be old enough to enter into these terms in your country (typically 18, or the age of majority where you live). If you are a minor, you may only use HyperOS with the involvement and consent of a parent or legal guardian, who accepts these terms on your behalf.

2. Terms of Service

HyperOS ("the project", "we", "us") is a free, non-commercial modification of Microsoft Windows, distributed for personal use by enthusiasts. These terms govern your use of the software and this website.

  • HyperOS is provided free of charge. We never sell it and there is no paid version.
  • You use HyperOS entirely at your own risk and are responsible for backing up your data before installing.
  • You are responsible for complying with the laws of your country, including Microsoft's own licensing terms for Windows.
  • We may update, change, pause or discontinue HyperOS, its features, or this website at any time, without notice or liability.
  • These terms, together with the disclaimer and privacy policy below, are the entire agreement between you and the project regarding HyperOS.

3. Licensing & Windows

HyperOS is a customized configuration of Windows. It is not a Microsoft product and is not endorsed by, affiliated with, or supported by Microsoft.

  • HyperOS does not include, sell, generate or provide any Windows license, product key or activation of any kind.
  • You are solely responsible for holding a valid, legally obtained Windows license for any machine you install HyperOS on.
  • You may not sell HyperOS, present it as your own work, bundle it with paid products, or redistribute modified copies as if they were official HyperOS builds.
  • Personal, non-commercial sharing with a link back to the official project is fine.

4. Acceptable use

When using HyperOS, this website or our community, you agree not to:

  • Use the project for anything illegal, or to help others do so.
  • Use HyperOS to gain an unfair advantage in games, cheat, or bypass anti-cheat systems — HyperOS is an optimization project, not a cheating tool.
  • Redistribute the build with malware, miners, or any added unwanted software.
  • Misrepresent the project, impersonate the team, or claim official status you don't have.

5. Disclaimer & warranty

HyperOS is provided "as-is" and "as available", without warranty of any kind, whether express or implied — including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Modifying an operating system carries inherent risk. Installing HyperOS involves formatting a drive and changing core Windows settings, which can result in data loss or an unbootable system if done incorrectly. We do not guarantee that HyperOS will be error-free, compatible with your hardware or software, or that any particular performance result will be achieved — real results vary by computer, components and usage.

It is your responsibility to understand what you are doing, to test in a virtual machine if unsure, and to keep current backups. If you are not comfortable with that, please do not install it.

6. Limitation of liability

To the fullest extent permitted by law, the HyperOS team and its contributors shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages — including but not limited to loss of data, loss of profits, hardware damage, lost or banned game accounts, downtime, or business interruption — arising from or related to your download, installation or use of HyperOS, even if advised of the possibility of such damage.

This includes damage caused by incorrect use, not following the documentation, or use of the optional advanced tools in the post-install toolkit. Because some jurisdictions do not allow certain limitations, some of the above may not apply to you; in that case liability is limited to the minimum permitted by law.

7. Donations & VIP

HyperOS is and always will be free. It is not a product and we sell nothing. The project runs only on voluntary donations, which go toward the time and hosting needed to keep it alive.

  • Donations are voluntary gifts, not a purchase, and do not unlock the software — the full build is already free to everyone.
  • As a thank-you, supporters may receive perks such as early updates and beta access to new builds. These perks are a courtesy, not a paid service or guarantee, and may change or end at any time.
  • Because donations are voluntary gifts and not a sale of goods or services, they are generally non-refundable unless required by law.
  • Any payment processor you use (for example a donation platform) has its own terms and fees, which are outside our control.

8. Privacy, analytics & cookies

This website is built to be privacy-first. It:

  • Does not use cookies and does not store anything on your device.
  • Uses Cloudflare Web Analytics for basic, aggregated traffic stats (such as page views, referrers and countries). It is cookieless, does not fingerprint you, does not track you across other sites, and collects no personally identifiable information.
  • No advertising, and we never sell data.
  • Does not collect personal data. There are no accounts, logins or forms that gather your information on this site.
  • Does not knowingly collect any information from children.

Because no cookies are used, no cookie-consent banner is required to browse this site. Standard, non-identifying server logs may be kept by our host for security and reliability, as is normal for any website. If we ever add anything that collects more than the above, we'll update this page and show a clear consent notice where required. You can read Cloudflare's privacy practices on their website.

9. Third-party services

HyperOS links to third-party services we don't control — most notably our Discord community, and tools mentioned in the docs such as Rufus and Ventoy. When you use those services, their own terms, privacy policies and cookies apply. We're not responsible for third-party content, availability or data practices. Please review their policies directly.

10. Trademarks

Windows and the Windows logo are trademarks of Microsoft Corporation. Game and anti-cheat names (such as EasyAntiCheat, BattlEye, FACEIT, RICOCHET and Vanguard) and other product names are the property of their respective owners. They are referenced here only descriptively, to explain compatibility, under nominative fair use. We do not use their official logos, and HyperOS claims no affiliation with, sponsorship by, or endorsement from any of these companies. If you own a mark referenced here and have a concern, contact us and we'll address it promptly.

11. Changes to these terms

We may update these terms from time to time as the project evolves. When we do, we'll change the "last updated" date at the top of this page. Continuing to use HyperOS or this website after changes are posted means you accept the updated terms. If a change is significant, we'll try to mention it in the community.
